    Penalty settlement

    • For simple violations, a Verwarnung (fine) is imposed. The fine is a maximum of € 55.
    • The fine must be paid on the spot or within a week. If a payment is not made or paid late, a Bußgeld procedure will follow.
    • Payment of the Verwarnung means that no objection / appeal can be lodged.
    • If there is a traffic offense (for example, injury or death as a result of a traffic accident), criminal proceedings will follow.

    Bußgeld procedure

In case of a more serious offense (fine higher than € 55) you will not receive a Verwarnung but will follow a Bußgeld procedure. A Bußgeldbescheid (decision) with an Anhörungsbogen or a Zeugenfragenbogen (questionnaire) is then issued or sent home.

    Points driver’s license

    • Germany has a penalty point system that also applies to foreigners. Only 1 to 3 penalty points are awarded for traffic violations with a fine starting at € 60 or traffic offenses.
    • If a driving disqualification or driving ban is imposed on the basis of this system, this only applies in Germany.

    Deposit

    • In case of non-direct payment of the Verwarnungsgeld, for example because an appeal is made, a Sicherheitsleistung (deposit) must be paid. This corresponds to the expected penalty plus costs.
    • If a driving disqualification or driving ban is imposed on the basis of this system, this only applies in Germany.

    Liability

In Germany, the driver is liable and responsible for paying the fine. If it is unclear who the driver has been, the license holder will be sent a Sow Fragenbogen (form) home.

    Arrest

In the event of an arrest, for example after a traffic accident, the embassy can provide information about the administration of justice and further proceedings.
