How the German fine system works
Germany has a federal traffic fine catalogue, the Bussgeldkatalog. It sets a fixed financial penalty (Bussgeld) for each offence, plus where applicable a number of penalty points to the central register in Flensburg, plus where serious enough a driving ban (Fahrverbot) of one to three months. The catalogue was last tightened by the StVO-Novelle on 9 November 2021; the speeding-tariff figures below are unchanged as of Stand Juli 2026 (source: bussgeldkatalog.org).
Three components can apply to a single offence:
- Monetary fine (Bussgeld): a fixed amount, due within 2 weeks
- Flensburg points (Punkte): stored in the central register, accumulate over years
- Driving ban (Fahrverbot): 1, 2 or 3 months, starts when you hand over the licence
For minor offences, a Verwarnungsgeld of €5-55 (§56 OWiG) is issued, no points, payable within 1 week. From €60 upwards the formal Bussgeldbescheid procedure (§65-67 OWiG) applies, with 2 weeks to appeal. If the Verwarnungsgeld is not paid, at least €28.50 in administrative fees is added and the matter escalates to the formal procedure.
Speeding fines
Different scales apply inside and outside built-up areas (innerorts vs. ausserorts). Built-up areas have stricter penalties.
Inside built-up areas
| Excess speed | Fine | Points | Ban |
|---|---|---|---|
| 1-10 km/h | €30 | 0 | - |
| 11-15 km/h | €50 | 0 | - |
| 16-20 km/h | €70 | 0 | - |
| 21-25 km/h | €115 | 1 | - |
| 26-30 km/h | €180 | 1 | 1 month* |
| 31-40 km/h | €260 | 2 | 1 month |
| 41-50 km/h | €400 | 2 | 1 month |
| 51-60 km/h | €560 | 2 | 2 months |
| 61-70 km/h | €700 | 2 | 3 months |
| Over 70 km/h | €800 | 2 | 3 months |
* Ban applies if 26-30 km/h excess is repeated within one year.
Outside built-up areas
| Excess speed | Fine | Points | Ban |
|---|---|---|---|
| 1-10 km/h | €20 | 0 | - |
| 11-15 km/h | €40 | 0 | - |
| 16-20 km/h | €60 | 0 | - |
| 21-25 km/h | €100 | 1 | - |
| 26-30 km/h | €150 | 1 | 1 month* |
| 31-40 km/h | €200 | 1 | 1 month* |
| 41-50 km/h | €320 | 2 | 1 month |
| 51-60 km/h | €480 | 2 | 1 month |
| 61-70 km/h | €600 | 2 | 2 months |
| Over 70 km/h | €700 | 2 | 3 months |
* Ausserorts asterisk applies to 26-30 km/h AND 31-40 km/h: the 1-month Fahrverbot activates only for Wiederholungstäter (a driver caught exceeding by 26+ km/h twice within one year, counted from when the first Bussgeldbescheid becomes legally binding). First-time offences at these tiers stay fine + points only.
School zones, construction areas and tunnels have NO separate 50% surcharge (common myth). The normal urban/rural tables apply. The fine CAN be doubled when deliberate intent (Vorsatz) is proven under § 3 Abs. 4a BKatV: if the court confirms the driver consciously noticed the speed-limit sign and still accelerated (OLG Brandenburg precedent). Doubling is intent-based, not location-based. Typical construction-zone limits: 60 km/h at narrow sections with workers present, 80 km/h at lane-narrowing without active work, 100 km/h in transition zones. The sign applies 24/7, even when no workers are visible. Additionally sign 264 (vehicle-width limit, usually 2.0-2.1 m) may close the left lane to wider cars or cars with mirrors extended : violation €20. All values above verified against the bussgeldkatalog.org tariff Stand Juli 2026 (unchanged since the 9 November 2021 StVO-Novelle).
Speed cameras
About 4,500 fixed speed cameras operate in Germany (Bußgeldkatalog.org, March 2026 figure; most in Baden-Württemberg), plus mobile police units. Tolerance is typically 3 km/h below 100 km/h and 3% above 100 km/h before a fine is issued. Foreign cars are detected via licence plate; for UK cars the post-Brexit reciprocity agreement enables enforcement in the home country.
Section-control (Streckenabschnittsmessung / Abschnittskontrolle) is not a nationwide German enforcement method. The legal basis exists only in Niedersachsen (§ 32 Abs. 7 NPOG, in force since 24 May 2019), and only one facility ever operated in Germany: on the B6 near Laatzen south of Hannover (pilot from Dec 2018, regular operation from 2021). That single installation was taken out of service in late 2023 / early 2024 and is being dismantled. As of 2026, there is no active section-control anywhere in Germany; a possible new site on the B210 near Wilhelmshaven is under evaluation but not deployed. All other federal states rely on fixed point-radars and mobile police enforcement.
Mobile phones and electronic distractions
Verified against bussgeldkatalog.org Stand Juli 2026. Hand-held use of any electronic device while driving:
| Offence | Fine | Points | Ban |
|---|---|---|---|
| First offence (hand-held) | €100 | 1 | - |
| With Gefährdung (endangering others) | €150 | 2 | 1 month |
| With Sachbeschädigung (causing property damage) | €200 | 2 | 1 month |
The rule applies to phones, tablets, laptops, navigation devices, e-cigarettes, MP3 players, smartwatches and any device that requires a button press or screen interaction. Voice-controlled mounted phones are legal. Even at traffic-light standstill with engine running, hand-held use counts.
Driving with headphones in both ears is not strictly forbidden but you must hear traffic; police can issue €10 warnings.
Alcohol and drugs
BKatV values verified against bussgeldkatalog.org Stand Juli 2026:
| Blood alcohol level | First offence (no accident) | Points | Ban |
|---|---|---|---|
| 0.0 (novices/Probezeit, under 21, commercial, § 24c StVG) | €250 | 1 | none (but Aufbauseminar + Probezeit +2 years) |
| 0.5-1.09 (Ordnungswidrigkeit), 1st offence | €500 | 2 | 1 month |
| 0.5-1.09, 2nd offence | €1,000 | 2 | 3 months |
| 0.5-1.09, 3rd offence | €1,500 | 2 | 3 months |
| 0.3-0.5 with erratic driving (Ausfallerscheinungen) | Straftat: no fixed OWi tariff | 3 | Entziehung Führerschein + Geld-/Freiheitsstrafe |
| 1.1 and above (absolute Fahruntüchtigkeit, § 316 StGB) | Straftat: no fixed OWi tariff | 3 | Entziehung Führerschein + Geld-/Freiheitsstrafe |
Drug driving (cannabis, cocaine, amphetamines, opiates above legal threshold): €500 + 2 points + 1-month ban for first offence; €1,000 + 2 points + 3 months for second; €1,500 + 2 points + 3 months for third. Note: drug driving with Gefährdung des Verkehrs (endangering traffic) escalates to 3 points + Entziehung der Fahrerlaubnis, and is prosecuted under § 316 StGB in serious cases.
Above 1.1 g/L is a criminal offence (Straftat) under § 316 StGB (Trunkenheit im Verkehr). Sanctions are court-imposed: monetary fine or imprisonment up to 1 year, mandatory Entziehung der Fahrerlaubnis (typically 6-12 months before reapplication is possible), and 3 Punkte on the FAER. Causing an accident under the influence adds § 315c StGB (Gefährdung des Straßenverkehrs) with prison up to 5 years, prosecuted independently of the Bussgeld.
Red lights, stop signs, overtaking
Red-light values verified against bussgeldkatalog.org Stand Juli 2026:
| Offence | Fine | Points | Ban |
|---|---|---|---|
| Running a red light, simple (under 1 second of red) | €90 | 1 | - |
| Simple red-light with Gefährdung (endangerment) | €200 | 2 | 1 month |
| Simple red-light with Sachbeschädigung (property damage) | €240 | 2 | 1 month |
| Qualified red-light (more than 1 second of red) | €200 | 2 | 1 month |
| Qualified red-light with Gefährdung | €320 | 2 | 1 month |

| Stop sign with priority offence | €70 | 1 | - |
| Overtaking on the right on autobahn | €100 | 1 | - |
| Tailgating (>80 km/h) under 5/10 of half-speedometer value in metres | €75 | 1 | - |
| Tailgating (>80 km/h) under 4/10 | €100 | 1 | - |
| Tailgating (>80 km/h) under 3/10 | €160 | 2 | 1 month |
| Tailgating (>80 km/h) under 2/10 | €240 | 2 | 2 months |
| Tailgating (>80 km/h) under 1/10 | €320 | 2 | 3 months |
Right-of-way offences (§ 8 StVO)
Legal basis: § 8 StVO + § 49 StVO + § 24 StVG + BKat Nr. 34. Primary verified via nexvyra.de + bussgeldrechner.org/vorfahrt + bussgeldkatalog.org.
Applies both to Rechts-vor-Links at unsigned junctions AND to disregard of right-of-way signs (sign 205 Vorfahrt achten / yield, 206 Stop, 301 Vorfahrtsstraße / priority road).
| Offence | Fine | Points |
|---|---|---|
| Right-of-way violation, no endangerment | €25 (warning) | 0 |
| With endangerment of others | €100 | 1 |
| With accident / property damage | €120 | 1 |
Grossly reckless behaviour (deliberately ignoring right-of-way with high risk) may trigger a criminal offence under § 315c StGB (Straßenverkehrsgefährdung) with up to 5 years prison. In accidents, right-of-way violation is deemed the primary cause in ~95% of cases.
Note for foreign drivers: Rechts-vor-Links is uncommon in Netherlands (priority is shown by sign), Spain and Poland (mostly explicit signage). In Germany the principle applies by default at EVERY unsigned junction, EVEN if the smaller street comes from the right. Extra caution needed in residential areas and old inner cities.
Roundabout offences (§ 8 Abs. 1a StVO)
Legal basis: § 8 Abs. 1a StVO + § 9 Abs. 1 StVO + BKat Nr. 139. Primary verified via nexvyra.de + bussgeldkatalog.org/kreisverkehr.
Indicator rule (true roundabout with sign 215+205): DO NOT indicate when ENTERING (§ 8 Abs. 1a Satz 2 StVO: indicating prohibited); DO indicate when LEAVING (§ 9 Abs. 1 StVO: leaving = turning). At an unsigned roundabout (no priority sign) general right-before-left applies and entering with indicator is required.
| Offence | Fine | Points |
|---|---|---|
| Indicating on entry or no indicating on exit | €10 (warning) | 0 |
| Wrong direction (anticlockwise instead of clockwise) | €25 | 0 |
| Driving over central island (not mini-roundabout) | €10 | 0 |
Right-of-way violation inside a roundabout: see Right-of-way section above (€100 + 1 point with endangerment, €120 + 1 point with accident; BKat Nr. 34).
Railway crossing offences (§ 19 StVO)
Legal basis: § 19 StVO + § 12 Abs. 3 Nr. 1 StVO (parking ban) + BKat Nr. 89-91. Primary verified via bussgeldkatalog.org/andreaskreuz + bussgeldkatalog.de/bahnuebergang + anwalt.org/bahnuebergang.
Rail traffic has absolute priority at level crossings. The Andreaskreuz (white X-shaped sign 201) is a mandatory sign. Parking is prohibited within 5 m of the Andreaskreuz inside built-up areas and within 50 m outside (both before and after).
| Offence | Fine | Points | Ban |
|---|---|---|---|
| Rail priority not observed | €80 | 1 | - |
| Light signal / flashing light / rail-staff signal ignored | €240 | 2 | 1 month |
| Unbarriered crossing crossed with flashing Andreaskreuz | €290 | 2 | 1 month |
| Closed barrier or half-barrier driven around | €700 | 2 | 3 months |
Where rail traffic is actually endangered (driving around a barrier while a train is approaching), § 315 StGB (endangerment of rail traffic) may additionally apply as a criminal offence with up to 5 years prison. Deutsche Bahn records ~160 level-crossing accidents per year, with motorist fault established in >95% of cases.
Mandatory equipment (Mitführpflicht)
Legal basis: § 53a StVZO (warning triangle + hi-vis vest) + § 35h StVZO (first-aid kit). Primary verified via bussgeldkatalog.de/warnwestenpflicht + bussgeldkatalog.de/warndreieck + bussgeldkatalog.de/verbandskasten.
German-registered cars must carry at least one hi-vis vest since 01.07.2014 (EN ISO 20471:2013 class 2 or 3; yellow, orange or red). In addition a warning triangle (standard ECE R-27) and a first-aid kit (DIN 13164, since 02.02.2022 including 2 FFP2 masks + 2 surgical masks) are mandatory. Foreign-registered cars are not legally obliged under German rules, but a vest and triangle are life-saving on autobahn or rural-road breakdowns.
| Offence | Fine | Legal basis |
|---|---|---|
| Warning triangle missing | €15 | § 53a Abs. 2 StVZO |
| Warning triangle wrongly placed | €30 | § 15 StVO |
| Hi-vis vest missing | €15 | § 53a Abs. 2 Nr. 3 StVZO |
| First-aid kit missing or expired | €10 | § 35h StVZO, DIN 13164 |
Correct warning-triangle placement (§ 15 StVO): 50 m in town, 100 m on rural roads, 150-200 m on autobahn behind the stranded vehicle. Put the hi-vis vest on before leaving the car (compulsory for the driver, strongly recommended for all occupants). First-aid-kit expiry is ca. 5 years: checked at every TÜV inspection; missing or expired usually triggers €10 (no points).
Parking and stopping
Parking tariffs verified against bussgeldkatalog.org Stand Juli 2026 (Parken table):
| Offence | Fine |
|---|---|
| Parking without ticket / overstaying, up to 30 min | €20 |
| Overstaying up to 1 h | €25 |
| Overstaying up to 2 h | €30 |
| Overstaying up to 3 h | €35 |
| Overstaying over 3 h | €40 |
| Parking on footpath or cycle lane | €55 (base); up to €100 + 1 point with Behinderung/Gefährdung/Sachbeschädigung |
| Parking on disabled bay without permit | €55 + 1 point |
| Parking in fire-brigade access lane | €55 (base); €100 + 1 point if blocking emergency vehicle |
| Parking on bus/tram lane or within 15 m of stop | €55 (base); up to €100 with Sachbeschädigung |
Note: base tariffs above match the current BKatV table. Aggravated cases (endangerment, obstruction, property damage) escalate to the ranges shown after the semicolon. Foreign-plated cars are routinely towed in central Berlin, Hamburg, Munich and Cologne. Tow-away fees are set by the municipality/operator and typically add €150-300 plus daily storage; these are not part of the national BKatV tariff.
Seatbelt and child-restraint duty
Legal basis: § 21a Abs. 1 StVO (seatbelt duty) + § 21 Abs. 1a StVO (child restraint) + BKat Nr. 99-101a. Primary verified via nexvyra.de + bussgeldrechner.org + bussgeld-info.de.
| Offence | Fine | Points |
|---|---|---|
| Adult (driver or passenger) not wearing seatbelt | €30 | 0 |
| Child without required child seat (belted only) | €30 | 0 |
| Child carried with no restraint at all | €60 | 1 |
| Several children with no restraint at all | €70 | 1 |
Child-seat duty: Children under 12 years or shorter than 150 cm must be transported in an approved child restraint (seat or booster). The duty ends as soon as the child exceeds one of the two limits (OR-OR). The driver is responsible for securing all children under 14 years old, not the adult passengers.
Practical: Child seats must be ECE R44/04 or ECE R129 (i-Size) approved. Rear-facing (reboard) seats up to at least 15 months are strongly recommended since i-Size introduction; some manufacturers extend reboarding to 4 years. Isofix mounting is standard in new cars since 2013.
Novice-driver probation (Probezeit, § 2a StVG)
Legal basis: § 2a StVG + Anlage 12 FeV. Separate system alongside FAER. Primary verified via nexvyra.de + bussgeldrechner.org/probezeit + bussgeldkatalog.org/aufbauseminar.
New German-licence holders are placed on a 2-year Probezeit after first Fahrerlaubnis acquisition. Does not apply to classes AM (mopeds), L and T (farm/forestry vehicles). Tiered sanction system:
| Stage | Trigger | Consequence |
|---|---|---|
| 1 | 1 A-offence OR 2 B-offences | MANDATORY Aufbauseminar (€750-€1,500) + Probezeit extended to 4 years |
| 2 | another A-offence OR 2 B-offences | Written Verwarnung + recommendation of voluntary traffic-psychology counselling (§ 2a Abs. 2 StVG) |
| 3 | one more offence | Licence revocation, Sperrfrist min. 3 months (§ 2a Abs. 5 StVG), reapplication usually requires MPU |
A-offence examples (serious): speeding ≥21 km/h over, mobile phone use, alcohol/drugs (0.0 ‰ limit, § 24c StVG), qualified red-light offence, failure to render assistance, Nötigung (coercion).
B-offence examples (lighter): worn tyres, expired HU/AU (MOT equivalent), inadequate load securing, sign violations without endangerment. A single B-offence has no Probezeit consequence yet: only 2 B-offences equal 1 A-offence.
Important for foreign novice drivers: anyone who obtained their licence in PL/ES/NL/UK is ALSO a novice driver in Germany during the first 2 years after first acquisition (regardless of issuing country). Foreign young drivers can lose their German driving right via BZSt (Bundeszentralamt für Steuern) and the EU driving-licence register.
The Flensburg point system
Every German driver and every foreign driver with a Bussgeld over a certain threshold gets recorded in the Fahreignungs-Bewertungssystem at the Kraftfahrt-Bundesamt in Flensburg.
| Points | Measure (§ 4 StVG + Anlage 13 FeV) |
|---|---|
| 1-3 | Vormerkung (recorded, no action) |
| 4-5 | Ermahnung (official reprimand) (written, paid, points to Fahreignungsseminar option) |
| 6-7 | Verwarnung (final warning) (written, paid, no point-reduction possible from here) |
| 8+ | Automatic licence revocation, Sperrfrist minimum 6 Monate, reapplication usually requires MPU (medical-psychological assessment) |
Points expire (Tilgungsfristen) after:
- 2.5 years for 1-point offences (Ordnungswidrigkeiten without Fahrverbot)
- 5 years for 2-point offences (Ordnungswidrigkeiten with Fahrverbot or certain Straftaten)
- 10 years for 3-point offences (Straftaten with licence revocation or Sperrfrist)
The Fahreignungsseminar (FES, § 4a StVG) is voluntary, costs ~€400 and reduces 1 Punkt once (total, not per offence). Only available at 1-5 points, maximum once per 5 years. From 6 points onwards: no point reduction possible. Not to be confused with the Aufbauseminar: that is a mandatory course for novice drivers in the 2-year Probezeit after an A-category offence (€750-1500, extends Probezeit to 4 years).
Foreign-licensed drivers do not enter the German Flensburg register because they have no German licence. Their offence is recorded against the licence number and can be communicated to the home authority via the EU Cross-Border Enforcement Directive.
Cross-border enforcement
Germany pursues fines abroad through the EU Directive 2015/413 (which replaced the earlier 2011/82). Member states share registration data and prosecute fines exceeding €70.
For UK drivers, the EU-UK Trade and Cooperation Agreement (2020) contains a reciprocal vehicle registration database arrangement. The Bundesamt fur Justiz (BfJ) in Bonn processes most foreign fines. Sequence:
- Speed camera detects vehicle
- Local Bussgeldstelle issues a Bussgeldbescheid in German plus a summary in the recipient country’s language
- Letter sent to registered owner via the foreign vehicle authority
- 2 weeks to pay or appeal
- After non-payment, the case escalates to a debt-collection agency, with potential court order
Pay online via www.bundesjustizamt.de using the file number on the letter. Cards and bank transfer accepted.
How to appeal
Within 2 weeks of receiving a Bussgeldbescheid you can lodge an Einspruch (objection) in writing. Common grounds:
- Wrong vehicle (theft, plate cloning)
- Wrong driver (you can refuse to name the driver, but the owner may then be required to keep a logbook)
- Calibration of the speed camera was not current
- Sign was missing or hidden
Hiring a specialised Verkehrsanwalt is common. Many drivers have legal-expense insurance (Verkehrsrechtsschutz) that covers this. About 30% of appeals succeed at least in part.
